An annulment is typically more beneficial because it is frequently less expensive and time consuming as there is no community property to divide in the case of an annulment. Additionally, legally each individual will be seen as if they were never married. A divorce is the dissolution of a valid marriage, which will result in the division of property. The following are generally the grounds for an annulment in Texas:

  • Under the age of 18
  • Under the influence of drugs or alcohol
  • Impotency
  • Fraud
  • Forced marriage
  • Invalid marriage license
  • Divorced within the past 30 days
  • Currently married.
